Pre-Nuptial Agreements

Pre-nuptial agreements, whether entered into in this country or abroad,  are not yet enforceable by the English courts. 

However, the courts do recognise that many people prefer to have the freedom to decide between themselves how their property should be divided on the breakdown of a marriage. 

If the agreement is entered into by both parties willingly without duress, and with the benefit of full legal advice, it may well be taken into account and followed by the Judge if the marriage later breaks down.
